General Terms and Conditions of Business


§ 1 Area of application
For the business relationship between the publishing house "Verlag Dr. Riedel e.K." and the "Customer" - including for all future transactions - the following General Terms and Conditions of Business are exclusively applicable in their version currently valid at the time the order is placed. Verlag Dr. Riedel e.K. does not recognise any conditions of the Customer at variance with these conditions, unless Verlag Dr. Riedel e.K. has expressly accepted the validity of these in writing.

§ 2 Conclusion of and withdrawal from contract
Verlag Dr. Riedel e.K. undertakes to accept the Customer's order under the conditions set out in the web site. In the event of spelling, printing or calculation errors in the web site, Verlag Dr. Riedel e.K. is entitled to withdraw from the contract.
If, in spite of contractual obligation, the supplier to Verlag Dr. Riedel e.K. no longer supplies Verlag Dr. Riedel e.K. with the goods ordered, Verlag Dr. Riedel e.K. is entitled to withdraw from the contract.

§ 3 Delivery
Unless otherwise agreed, the delivery of books and CDs takes place from the warehouse to the delivery address stated by the Customer. The risk is transferred to the Customer as soon as the delivery is handed over by Verlag Dr. Riedel e.K. or one of its authorised agents to the forwarding carrier, even if the shipment takes the form of part deliveries.

§ 4 Due date and payment, late payment
The purchasing price for online seminars, books and CDs is due for payment immediately the order is placed. The Customer can pay the purchase price by means of invoice or credit card. If the Customer's payment is late, Verlag Dr. Riedel e.K. is entitled to apply interest at a rate of 5% above the annual base rate of interest announced by the Federal German Bank. Where it can be shown that Verlag Dr. Riedel e.K. has suffered greater damages as a result of this late payment, Verlag Dr. Riedel e.K. is entitled to claim the corresponding amount.

§ 5 Offsetting, retention
The Customer is only entitled to offset claims where his counter-claims have an established legal basis, or they have been acknowledged by Verlag Dr. Riedel e.K. Furthermore, he is only entitled to exercise a right of retention to the extent that his counter-claim is based on the same contractual relationship.

§ 6 Reservation of ownership
Until complete settlement of all existing claims against the Customer, goods delivered remain the property of Verlag Dr. Riedel e.K.

§ 7 Warranty and liability for defects
In the event of a defect in the item purchased for which Verlag Dr. Riedel e.K. is responsible, Verlag Dr. Riedel e.K. is entitled, at its own discretion, either to make good the defect or to deliver a replacement. If Verlag Dr. Riedel e.K. is not prepared, or is not in a position, to make good the defect/deliver a replacement, or if this remedy should be delayed beyond a reasonable time for reasons for which Verlag Dr. Riedel e.K. is responsible, or if in some other way the operation to make good the defect/deliver a replacement should be unsuccessful, the Customer is entitled, at his own discretion, to withdraw from the contract or to demand a corresponding reduction in the purchase price.
Unless based on any other conditions stated below, any further claims of the Customer - on whatever legal grounds - are excluded. Verlag Dr. Riedel e.K. is accordingly not liable for damages which have not arisen directly to the item delivered itself; in particular, Verlag Dr. Riedel e.K. bears no liability for loss of profits or for any other damages to the Customer's property. To the extent that the liability of Verlag Dr. Riedel e.K. is excluded or restricted, this applies likewise for the personal liability of employees, representatives and authorised agents.
The above restriction of liability does not apply where the cause of the damages is associated with deliberate intent or gross negligence. Furthermore, it does not apply where the customer makes claims on the basis of §§ 1, 4 of the Product Liability Act (Produkthaftungsgesetz), due to the absence of an assured characteristic or claims for compensatory damages due to failure to fulfil obligations in accordance with §§ 463, 480 Section 2 of the Federal Law Gazette (BGB). The same applies in the event of initial inability to perform or impossibility of performance for which responsibility is borne.
In the event that Verlag Dr. Riedel e.K. should breach a significant contractual obligation due to negligence, the obligation to provide compensation for material or personal damages is restricted to the damages typically arising.
The warranty period amounts to 12 months, dating from transfer of risk. This set period is a period of limitation and also applies for claims for compensation for consequential damages due to defects, to the extent that no claims can be made on the basis of prohibited actions.


§ 8 Data protection
We use secure technology: our SSL security server software is one of the best in the field of online trading. Our security server software encodes all of your personal data, such as your credit card number, bank sort code, bank account number, name and address. When being transmitted over the Internet, these details cannot be read by any unauthorised party. During the encoding process, the characters you enter are converted into a code which can be safely transmitted over the Internet. At Verlag Dr. Riedel e.K. your satisfaction is our primary concern and it is part of our remit to protect the sphere of your privacy. We use the details we gather about you to execute orders.
What details do we collate? How do we use them?
· When you pass an order on to us, we have to ask for your name, your e-mail address, your (delivery) address, your bank's sort code and your account number and, where relevant, your credit card number and its expiry date. This allows us to process and execute your order and keep you up to date on the status of the order.
· To allow you to log on to our e-mail information service (e.g. "
BSB-Newsletter") all we require is your e-mail address.
How does Verlag Dr. Riedel e.K. protect customers' details?
Verlag Dr. Riedel e.K. uses a secure transmission procedure - known as "Secure Socket Layer" (SSL) transmission - for processing customers' details. All details passed on to us by means of this secure method are encoded before being transmitted to us.
Will Verlag Dr. Riedel e.K. make use of this information in any other way in the future?
Verlag Dr. Riedel e.K. does not make your personal details available to any third party. It is possible that we may make statistics relating to our customers, sales turnover, customer behaviour and associated site information available to third parties on a confidential basis. However, this information will be collated in such a way that it will not be possible to identify any individual person's details from it.

§ 9 Applicable law and place of jurisdiction

German law shall be applicable, to the exclusion of the UN Sales Legislation.
